Tussle over Saif Gaddafi’s trial: Should Libya’s courts decide his fate?-Africa Today-05-15-2012
The trial of Africans at The Hague had often come about due to the lack of proper legal and judiciary system capable of effectively administering justice. But Libya seems to be ready to have its courts decide the fate of Saif. So why the ICC is still bent on extraditing Saif to face trial at the Hague? Is it a ploy to cover up some secrets between his late father and western allies who later toppled him? Libya has formally asked the international criminal court to abandon its legal action against Saif al-Islam Gaddafi and the country’s former intelligence chief so that both men can be tried in Tripoli, where they could face the death penalty. The 58-page submission, drawn up with the help of British lawyers, argues that the country is restoring its judicial system rapidly and that the men should be tried for their alleged crimes in a national court. Saif al-Islam, who studied at the London School of Economics, was expected to succeed his father, Muammar Gaddafi. After the regime fell, he was captured last November near the town of Obar while apparently fleeing to Niger. The Libyan government insists he has been held in “adequate conditions of detention” in the southern city of Zintan, “which will improved even further” once he is transferred to a prison in Tripoli. Gaddafi’s rapprochement with the West may be solely to strengthen his own regime. But what are the implications of this new policy for Libya? “Nothing has changed.” complains Libyan dissident Ashur Shamis. “Gaddafi and his cronies want to keep things as they were before.” For ordinary Libyans, Gaddafi’s marriage of convenience with the West is no cause for celebration. They see it purely as a means of strengthening his despotic regime and avoiding having to make any real reforms. Libyan expert George Jaffe agrees. “Colonel Gaddafi’s fundamental concern is to keep his regime in being.” Years of economic sanctions had left Libya’s economy in ruins. Trapped between the rising anger of his own people and a more aggressive United States, Gaddafi was forced to act. “All of us agreed that Libya should adopt several reforms,” explains his son and heir, Seif Gaddafi. So Libya renounced terrorism, dismantled its nuclear programme and accepted responsibility for Lockerbie. But has anything really changed? It’s still illegal to form political parties and criticise the regime. Watch Dictatoe for Free on tiny.cc The Dictator is an upcoming 2012 British/American comedy film written by and starring Sacha Baron Cohen. Baron Cohen’s fourth film will “tell the story of a dictator who risked his life to ensure that democracy would never come to the country he so lovingly oppressed”, according to Paramount Pictures, which will distribute the film. Larry Charles, who previously directed Baron Cohen’s mockumentaries Borat and Brüno, will also direct the film. Baron Cohen will star alongside Ben Kingsley and Anna Faris. Baron Cohen will play the role of Admiral General Aladeen, a dictator from the fictional Middle Eastern country of the Republic of Wadiya. The film is said to be inspired by the novel Zabibah and the King by Iraqi leader Saddam Hussein. This genre of film has been done before also in Charlie Chaplin’s The Great Dictator, a polemic paradoy of Hitler. The trailer alludes to the fact that the film is also inspired by the Libyan leader Muammar Gaddafi, due to the character’s visit to the United States and his all-female security force. Furthermore, the archive news footages of US President Barack Obama and British Prime Minister David Cameron.
